Toledo, de 80 a\u00f1os, alegaba que esta norma lo habilitaba a acogerse al beneficio.<\/p>\n\n\n\n<p>Sin embargo, el juez Richard Concepci\u00f3n Carhuancho rechaz\u00f3 el requerimiento, al considerar que no correspond\u00eda su aplicaci\u00f3n en este caso. La Corte Superior Nacional de Justicia Penal Especializada fue enf\u00e1tica en su decisi\u00f3n.<\/p>\n\n\n\n<p>Durante el proceso, el Ministerio P\u00fablico se opuso a la solicitud, advirtiendo un alto riesgo de fuga por parte de Toledo, lo que podr\u00eda significar una evasi\u00f3n de la justicia.
